DMCA
At Rhythm of Strength, we respect the intellectual property rights of others and are committed to complying with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been posted on our platform without your permission, we provide a straightforward procedure for submitting a DMCA takedown notice.
Filing a DMCA Notice
To file a valid DMCA notice, please include the following information:
- Your Signature: Either a physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Description of the Copyrighted Work: A thorough description of the work you believe has been infringed.
- Identification of the Infringing Material: A clear identification of the material you believe infringes your copyright, along with its location on our platform (such as the URL).
- Good Faith Statement: A statement confirming that you believe, in good faith, that the material in question is being used without authorization.
- Accuracy Certification: A declaration under penalty of perjury that the information provided in the notice is accurate, and that you are authorized to act on behalf of the copyright holder.
- Contact Information: Your full name, address, telephone number, and email address.
Processing DMCA Notices
Once we receive your valid DMCA notice, we will promptly take appropriate action to remove or disable access to the allegedly infringing material. We will also inform the user who uploaded the content and provide them with an opportunity to dispute the claim via a counter-notification.
Counter-Notification Procedure
If you receive a notice indicating that your content has been removed due to a DMCA claim and believe that it was removed in error, you may submit a counter-notification. A valid counter-notification must include:
- Identification of the Removed Content: The material that was removed and its location prior to removal.
- Mistake Statement: A statement under penalty of perjury that you believe the removal was a mistake or misidentification.
- Your Contact Information: Name, address, phone number, and email.
- Jurisdiction Agreement: A statement agreeing to the jurisdiction of the federal court in the district where you reside.
- Your Signature: Either a physical or electronic signature.
Response to Counter-Notifications
If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not initiate a legal action within 10-14 days, the content may be restored.
